Council bye-laws

Local government legislation: bye-laws

Introduction

Bye-laws are local laws made by the council under an enabling power contained in a public general act or a local act requiring something to be done – or not done – in a specified area. They are accompanied by some sanction or penalty for their non-observance.

If validly made, bye-laws have the force of law within the areas to which they apply. Generally bye-laws are overseen by the relevant government department or confirming authority who has policy responsibility for the subject matter.

Bye-laws are enforced by the council through the magistrates’ court and contravening a bye-law can result in a fine upon successful conviction.

We have bye-laws for our leisure & community facilities which form an extensive estate.  It includes: football pitches, play parks, community facilities, leisure facilities, cemeteries, public walks and golf courses.

This bye-law covers the following areas:

  • public access
  • protection of property
  • protection of flora and fauna
  • protection of the public
  • general management
  • public meetings
  • vehicles
  • sports, games and other activities including drones
  • animals
  • children's play areas
